General terms and conditions of sale of "pauline.one e.k." G. Seidel

 

1. Scope of application

1.1 The following general terms and conditions of sale (hereinafter also referred to as "GTCS") apply to all contracts between "pauline.one e.k." and the buyer (hereinafter referred to as the "customer") for the sale and / or the delivery of goods (hereinafter referred to as "goods").

1.2 These GTCS apply to the exclusion of any other terms and conditions. Deviating, contradictory or supplementary terms and conditions of the customer are not part of the contract unless "pauline.one e.k." has explicitly agreed to these in writing.

This consent is required even if "pauline.one e.k.", being aware of the terms and conditions of the customer, carries out the delivery to the customer without reservation.

1.3 Any separate agreements concluded with the customer on a case-by-case basis (including side agreements, amendments or addenda) will, in any case, take precedence over these GTCS. For these arrangements to be effective, they must be agreed to or confirmed by "pauline.one e.k." in writing.

 

2. Registration

2.1 Registration is open to individuals who are 18 years of age or older.

2.2 The details provided by the customer during the registration process (website, fax) must be complete and accurate. Should the information provided by the customer change after the registration, the customer is obliged to correct the data as soon as possible.

2.3 The customer is obliged to keep the personal password chosen at the time of registration on the website secret and not disclose it to third parties. The customer is responsible for all actions on the website attributable to his or her password.

The customer shall receive a confirmation of his or her successful registration by email.

 

3. Orders

3.1 Orders can be placed at "pauline.one e.k." as follows:

3.2 If a specific item is not available, "pauline.one e.k." shall alert the customer to the fact before accepting the order.

 

4. Conclusion of contract

4.1 By placing an order, the customer submits a binding offer to purchase the chosen goods. "pauline.one e.k." accepts the offer of the customer by sending the ordered goods. The order is placed subject to the prices and conditions applicable at the time of the order.

4.2 If an order is placed through the website, "pauline.one e.k." will promptly send the customer a confirmation of the acceptance of the offer by email.

4.3 "pauline.one e.k." is entitled to reject orders, apply quantitative limits, set credit limits or demand payment in advance, especially in the case of unpaid invoices, credit risk or insolvency of the customer.

 

5. Right to cancel

You have the right to cancel this agreement within 14 days without giving any reason.

The cancellation period will expire fourteen days from the date on which you or a named third party, other than the carrier, have taken possession of the goods.

To exercise the right to cancel, you must inform us, by contacting us at pauline.one e.k.

of your decision to cancel this contract by a clear statement.

To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the cancellation period has expired.


Effects of cancellation

If you cancel this contract, we will refund all payments received from you, including the costs of delivery (except for the supplementary costs arising if you choose a type of delivery other than the least expensive type of standard delivery offered by us) without undue delay and within fourteen days. Unless expressly otherwise agreed, we will use the same means of payment for your refund that you used to pay for your order. We may withhold the refund until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

You shall send back the goods or hand them over to

without undue delay and in any event not later than fourteen days from the day on which you informed us of your decision to cancel this contract. The deadline is met if you send back the goods before the period of fourteen days has expired. We shall bear the cost of returning the goods.

You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.

6. Delivery and delivery costs

6.1 Unless otherwise agreed, "pauline.one e.k." shall send the goods to the delivery address specified by the customer.

6.2 The customer will be charged separately for the packaging and delivery of the goods in accordance with the following schedule ("delivery costs").

6.3 Irrespective of the goods ordered and their quantity, the customer shall bear the cost of delivery as well as any additional costs that may arise if he or she chooses a type of delivery other than the standard delivery offered by "pauline.one e.k.".

6.4 As this does not qualify as a purchase of consumer goods (Article 474 (1) of the German Civil Code (BGB)), the risk passes to the customer upon handover of the goods to the carrier.

6.5 Any information provided regarding the time of dispatch or delivery of the goods is indicative and shall not be construed as binding or guaranteed information concerning the dispatch or delivery dates.

 

7. Rescinding the contract

7.1 After two unsuccessful delivery attempts, where the goods could not be handed over to the customer or the customer has failed to pick the goods up after being given adequate notice, "paulin.one ek" will be entitled to rescind the contract and refund any payments already collected. Any delivery costs are non-refundable and shall be borne by the customer. 

 

8. Returning goods 

8.1 If the goods can be returned by post, the customer is required to package the goods in a manner that protects the goods against typical transport risks.

9. Prices

9.1 The prices specified on the website www.handbagstars.com are quoted exclusive of VAT at the applicable rate.

 

10. Payment terms

10.1 The customer can pay by credit card, PayPal, bank transfer, Paydirekt or on invoice (for business customers)

10.2 If the customer fails to pay within the payment period agreed in the contract or specified on the invoice after the payment becomes due or receipt of the invoice, the customer will be deemed to have fallen into arrears.

The customer will be charged reminder fees every time he or she falls into arrears and a reminder is issued. 

 

11. Retention of title 

11.1 "pauline.one e.k." will retain title to the goods until the purchase price has been paid in full.

 

12. Right to set off/withhold payment

12.1 The customer is not entitled to set off his or her own claims against payment claims of "pauline.one e.k." unless the claims of the customer are undisputed or legally established.

 

13. Data protection

13.1 "pauline.one e.k." collects customer data as part of contract processing and shall take all necessary measures to protect the personal data made available by the customer and to comply with the applicable German and European data protection laws and regulations at all times.

 

14. Applicable law and place of jurisdiction

14.1 These general terms and conditions of sale and the processing of all contracts are governed by the laws of the Federal Republic of Germany.

14.2 If the customer is a business or a legal entity, the place of jurisdiction for any disputes arising directly or indirectly from the contractual relationship will be Wiesbaden, Germany. The same applies if the customer's general place of jurisdiction is not in Germany, the customer has moved his or her domicile or habitual residence abroad after the conclusion of the contract, or if the domicile or habitual residence is unknown at the time of institution of legal proceedings. 

 

15. Invalid provisions 

Should one or several provisions of these general terms and conditions of sale be invalid, the validity of the general terms and conditions as a whole will remain unaffected thereby. The invalid provision will be replaced by the relevant statutory provision.
